A decision was made regarding the Poma accident two summers ago:

CALGARY - A Rocky Mountain ski resort has been charged in the death of one of their workers two years ago.

Sunshine Village Corporation is facing charges under the Workplace Health and Safety Act.

Karl Stunt, 25, was on his first day of work as an assistant to a ski lift mechanic when the accident occurred.

He was on a work platform being transported by a ski lift when the platform struck the lift terminal. Stunt was hit in the head by a piece of the platform. He went into a coma and died seven days later.

Stunt's family said they're angry it took nearly two years to complete the investigation.

"It's unconscionable that you have to wait two years," Bill Stunt, the victim's father, said from Ottawa.

The maximum penalty for a first offence under the act is $500,000 or six months in prison."

Bad deal - poor kid - never heard about it.

Anyone know if it was a manufactured work chair or if the resort fabricated it?

Sunshine Village Cleared on Appeal in Ski Resort Worker's Death

Calgary (AB), Canada - A Canadian appeals court judge on Wednesday overturned the 2009 conviction of Sunshine Village Ski Resort near Banff, Alberta, in the 2004 death of a ski lift worker.


Sunshine Village employee Jan-Karl Stunt, 25, was killed when a piece of metal struck his head as the chair in which he was riding collided with a lift terminal. A lower court in Banff had found Sunshine Village negligent under Canada's the Occupational Health and Safety Act and ordered the resort to pay a C$5,000 fine and fund a C$250,000 scholarship in ski resort management at Selkirk College in British Columbia.

On Wednesday, Justice Suzanne Bensler ruled that the accident was "bizarre and unforeseeable," and that while the momentary inattentiveness of two fellow employees contributed to Stunt's death, Sunshine Village is "not required to achieve a standard of perfection."

With Sunshine Village prevailing on appeal, resort officials have indicated that the Selkirk College scholarship mandated by the lower court judge will not be funded.

I'm not really sure what to think about this decision. 'Bizarre and unforeseeable'?
