Airspace requirements:
You need to have a certain amount of clearance around your lift to certify it. If you plan to ski under it, the clearance is at least 20 feet from skis to ground, while if you don't plan to ski under it it's only 8 feet. Not having ever seen the Eskimo, I don't know what C.A. is talking about, but I think it must be related to something that was messed up in construction. Else, why would there be a permanent variance? The modification he's asking for could be concerning some summer grooming they did.

Here's the Canadian version of that (not in official words :) )
no ropes are required if we maintain a clearance of 4 m (13 ft)
if we are under 4m, we must rope the area off and maintain a clearance of 2.2m (7.22 ft)
And that is from the bottom of the chair, not the skis.

There is a run at Northstar under Lookout Mountain Express, "gooseneck", that remains perfectly fine during most of the season, but then has to be roped off come late winter under just the downloading side as the snowpack accumulates.
